Estate Agent and Founding Agent Terms

AgentPitch is run by a sole trader and is not a limited company. The operator's full legal name is set out in our Privacy Notice (section 1, Who we are).

In these terms, "AgentPitch", "we" and "us" mean the sole trader who operates AgentPitch, named in our Privacy Notice. These terms are between AgentPitch and the estate agency business you represent ("your agency"). By accepting them you confirm you're authorised to agree to them for your agency. They apply to everyone at your branch who uses AgentPitch. Please read them with our Privacy Notice.

• AgentPitch is an online introduction platform that lets sellers request and compare written proposals from estate agents.
• AgentPitch is not an estate agent and does not represent sellers or your agency. We don't negotiate for either side.
• Any agency agreement is made directly between your agency and the seller, on your own terms of business. AgentPitch is not a party to it.
• We don't guarantee any number of enquiries, invitations, valuations or instructions.

• We review every application and may decline one or ask for more information.
• Your agency must meet the legal requirements for estate agency work in England, including membership of a government-approved redress scheme and supervision for anti-money-laundering purposes, and must tell us if that changes.
• Information you give us about your agency and branch must be accurate. Changes to branch details are checked by us before they appear.

• Free during the pilot. Approved Founding Agent branches use AgentPitch free of charge during the pilot. We don't ask for card details.
• No automatic charges. Your agency will never be charged automatically, and a free account will never turn into a paid one by itself.
• Fees only with your explicit agreement. If we introduce paid plans, we'll send your agency a separate written offer setting out the price, what's included and how to cancel. Charges would apply only if an authorised person at your agency expressly accepts that offer. You're free to decline it.
• Before the pilot ends or anything about your access changes, we'll give you reasonable notice and explain your options.

• Invitations are sent at our discretion. You'll have 48 hours to respond; proposals can't be sent after the deadline.
• Proposals must be honest, accurate and not misleading, and must comply with consumer protection law, including the rules on giving sellers the information they need to make decisions. Valuations should be your genuine professional opinion supported by evidence, not inflated to win an instruction. Fees must be clear, including whether VAT is included.
• Once sent, a proposal can't be edited. Revised advice after a visit is shown as a separate update.
• Respond to valuation requests and booking changes promptly, and keep appointments you confirm.
• Only claim an instruction if the seller has actually instructed your agency.

• When a seller allows your branch to receive their full address and contact details, your agency becomes an independent controller of that data under the UK GDPR. You're responsible for your own lawful use, privacy information, security and retention.
• Use a seller's details only for that seller's valuation and any instruction that follows. Never use them for unrelated marketing, and never share them with third parties except as the law or the seller allows.
• Keep your AgentPitch login secure and give access only to staff who need it.
• Tell us promptly at hello@agentpitch.co.uk if you think AgentPitch data has been misused or exposed.
• Never try to see other branches' proposals or sellers' details you haven't been given.
• Don't try to identify, visit or contact a seller using the limited enquiry details (street name, postcode district and property details) before they choose to share their contact details with your branch.
• AgentPitch uses the personal data of your branch staff as described in our Privacy Notice. Please make sure colleagues you add know about it.

You allow AgentPitch to show your agency and branch names, logo, office details, website, Instagram name, proposals and attached documents to the sellers you respond to, and to use them to run the service. You confirm you have the right to use that content.

If you add a review rating from a public listing, it must be accurate on the date you give. We check it before it's shown, label it as agent-supplied, and hide it once it's more than 90 days old unless you update it.

• Your agency can stop using AgentPitch at any time, without charge. Email us to close your branch account.
• We may suspend or remove a branch for breaking these terms, repeated complaints, or legal or regulatory concerns. Unless it's urgent or the law prevents it, we'll tell you why first and give you a chance to respond.
• Ending your use of AgentPitch doesn't affect agreements your agency has already made directly with sellers.

• We'll run the platform with reasonable care and skill, but can't promise it will always be available or error-free.
• We're not responsible for sellers' decisions, for any instruction or commission you do or don't win, or for your agency's dealings with sellers.
• The service is provided to your agency as a business. As far as the law allows, AgentPitch is not liable for loss of profits, sales, business, commission or goodwill, or for any indirect or consequential loss.
• Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot legally be limited.

If you're unhappy with AgentPitch, email hello@agentpitch.co.uk with your branch name and what happened. We'll acknowledge your complaint, look into it and reply to you.

We may update these terms. If changes are important, we'll ask you to review and accept the new version before your branch sends another proposal. Changes will never introduce fees without your agency's explicit agreement. If the AgentPitch business is transferred (for example to a limited company set up by its owner), we may transfer this agreement to the new operator and will tell you beforehand. Nobody else has any rights under these terms. If a court decides part of these terms can't be enforced, the rest still applies. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
